These terms of use (“Terms”) apply to the IDEMIA developer portal website (“Site”). BY USING THE SITE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT REGISTER AND EXIT THIS SITE. IDEMIA reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms at any time. Continued use of the Site following any changes in the Terms constitutes acceptance to such changes. The current version of the Terms can be accessed at any time by clicking on the “Terms of Use” link at the bottom of our web pages. By entering into these Terms you confirm you are acting as a professional in a strictly business capacity and not as a "consumer".
These Terms provide you with mandatory legal information and IDEMIA confidentiality Policy. It informs you about personal data that IDEMIA may collect and how it may use it.

The following legal notice applies to all Internet users visiting these sites (“User”). IDEMIA thanks you for reading it carefully before accessing any pages, documentations, data base, logo, trademark, diagrams, demonstrations, tutorials, getting started guides, open APIs, API, SDK of other software programs and more generally any information whether protectable or not under Intellectual Property Laws (the Content) contained in or accessible via the Site. This Site, created by IDEMIA, gathers information intended for an institutional presentation and a test of some IDEMIA's digital solutions. IDEMIA reserves the right to modify the Content of the Site at any time and without notice and IDEMIA cannot be held responsible for the consequences of such modifications. Access and use of this Site or its content are subject to the conditions below and to the legal provisions in force. IDEMIA reserves the right to deny access to demos, API or SDK. IDEMIA reserves the right to terminate the access right and any relevant licenses granted to a company or its employee at any time. Upon termination, User shall immediately cease all use of the Site and its Content, and destroy all copies, full or partial, of the Content. Sections Hypertext link, Intellectual Property, Data collection, Disclaimer of warranties and Miscellaneous shall survive the termination. By accessing the Site, you accept, without limitation or qualification, these terms. IDEMIA shall not be liable for your access to the Site and any activity occurring under your account details. If you become aware of any suspicious usage of your login or password or any identification details relating to your account you must immediately notify IDEMIA.

The Site may contain information about, links to, and/or advertisements for web sites operated by Relying Parties or other parties (the "Third Party Sites"). Intellectual Property
The trademarks, service marks, and logos (the "Trademarks") domain names, software, database, interfaces, information in the form of text or images on the Site and more generally any Content that are used and displayed in connection with the Site are either protected under IDEMIA Intellectual property and/or registered and unregistered trademarks or service marks of IDEMIA, its licensors or partners. Nothing in these Terms shall be construed as granting, by implication, estoppel, or otherwise, any rights to use any Trademark displayed on this Site without the prior written consent of from IDEMIA for each such use. The Trademarks may not be used to disparage IDEMIA or the applicable third-party's products or services, or in any manner (using commercially reasonable judgment) that may damage any goodwill in the Trademarks. Use of any Trademarks as part of a link to or from any website is prohibited without prior written consent from IDEMIA. All goodwill generated from the use of any IDEMIA -owned Trademark shall inure to IDEMIA's sole benefit.
IDEMIA reserves and you hereby acknowledges and agrees to the reservation by IDEMIA (or its licensors) all ownership right, title, and interest in and to the Content and the intellectual property rights in and to the Content, including all right, title, and interest in and to any derivative works, translations, or any other modifications thereof. These Terms and the License Agreement granted herein are not a sale of a copy of the Content and do not render you or the User the owner of a copy of the Content. Ownership of the Content and all components and copies thereof shall at all times remain with IDEMIA and its licensors, regardless of who may be deemed the owner of the device in or on which the Content is downloaded and installed.
The Content contains proprietary intellectual property rights belonging to IDEMIA and its third-party licensors. User shall not directly or indirectly: (a) copy the Content ; (b) transfer, sublicense, resell, distribute, publicly display, or publicly perform the Content, or any copy thereof, either in whole or in part, by any means whatsoever, or otherwise make it available for use by others in any sharing, service bureau, or similar arrangement; (c) modify, decompile, disassemble, decrypt, extract, reverse engineer or reverse compile the Content, or otherwise attempt to discover or derive the source code, confidential algorithms or techniques incorporated in the Content, or disclose or use any confidential information of IDEMIA in any manner; (d) use the Content for any illegal purpose, in any manner that is inconsistent with these Terms, or to engage in any illegal activity; (e) use any third -party -licensed component of the Content separately and apart from the Content; (f) prepare derivative works based on the Content or any part thereof; or (g) circumvent, disable, or otherwise interfere with security-related features in the Content. User may not use the Content in any manner which could damage, disable, overburden, or impair the IDEMIA’s system, services, or servers or interfere with any other party's use and enjoyment of the Software or related services. User may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Content. Content developed by a company other than IDEMIA is protected by their respective intellectual property rights and shall be used under license of their original developer of which User / Developer acknowledges the enforceability and applicability.
The Content is for use by Users who are eighteen (18) years of age or older. Users under the age of eighteen (18) are not permitted to use the Content without the consent of a parent or legal guardian. By using the Content, User represents that he/she is at least eighteen (18) years of age, or has the consent of a parent or legal guardian.
Disclaimer of Warranties.
IDEMIA, ITS AFFILIATES AND LICENSORS (COLLECTIVELY, THE "IDEMIA PARTIES") MAKE NO WARRANTIES TO LICENSEE ABOUT THE CONTENT, INCLUDING BUT NOT LIMITED TO ITS ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY. THE IDEMIA PARTIES SHALL NOT BE SUBJECT TO LIABILITY FOR THE ACCURACY OR COMPLETENESS OF ANY CONTENT OR ANY OTHER INFORMATION CONVEYED TO USER THROUGH THE CONTENT, OR FOR ERRORS, MISTAKES OR OMISSIONS THEREIN, OR FOR ANY DELAYS OR INTERRUPTIONS OF THE DATA OR INFORMATION STREAM FROM WHATEVER CAUSE. USER AGREES THAT USE OF THE CONTENT IS AT USER’S OWN RISK. THE IDEMIA PARTIES DO NOT WARRANT THAT THE CONTENT WILL OPERATE ERROR-FREE OR THAT THE CONTENT IS FREE OF COMPUTER VIRUSES OR SIMILAR CONTAMINATION OR DESTRUCTIVE FEATURES. THE IDEMIA PARTIES ARE NOT LIABLE OR RESPONSIBLE IN ANY WAY FOR ANY LOSSES OR DAMAGES RELATED TO OR ARISING FROM USER’S USE OF THE CONTENT THAT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA. THE CONTENT IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. ACCORDINGLY, THE IDEMIA PARTIES DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, AND FITNESS FOR A PARTICULAR PURPOSE.
The text, graphics, images, reports, charts, graphics, data, and data files made available through the Content is presented in a summary fashion, and is intended to be used for educational and informational purposes only, and nothing in the Content is intended to constitute professional legal advice.
Miscellaneous
These Terms are governed by the laws of France, without respect to its conflict of laws provisions. Paris Court of Law shall be exclusively competent for any disputes, in connection or arising out of these Terms, which cannot be settled amicably. Nothing in these Terms excludes or limits IDEMIA’s liability for any liability that cannot be excluded or limited by law. Notwithstanding anything to the contrary, IDEMIA’s total aggregate liability arising under or in connection with these Terms, whether in tort, contract, misrepresentation or otherwise, shall be limited to 500€ (five hundreds euros) in aggregate.
A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that these Terms and all related documents be drawn up in English.
If any provision of these Terms is found to be invalid by an arbitrator or any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. Failure of IDEMIA to act on or enforce any provision of these Terms shall not be construed as a waiver of that provision or any other provision in these Terms. No waiver shall be effective against IDEMIA unless made in writing, and no such waiver shall be construed as a waiver in any other or subsequent instance.
